1. Agreement Overview
These Terms and Conditions govern the agreement between Magical Moments and the client for photography and/or videography services. By booking with us, you agree to these terms.
2. Booking and Payment

A non-refundable booking fee of $50.00 amount is required to secure your session date.

The remaining balance is due before the event/session starts unless otherwise agreed.

Payment can be made via bank transfer or in person.
3. Cancellation and Rescheduling

Cancellations must be made in writing.

The booking fee is non-refundable under all circumstances.

If you reschedule with at least 15 days notice, we will try to accommodate the new date (subject to availability).

If the client does not attend the booking a new booking is required with a new deposit.
4. Client Responsibility

You are responsible for ensuring that all participants are on time and ready at the agreed location.

Please notify us in advance of any location changes, special requirements, or accessibility needs.

Any permits or fees required for the chosen location are your responsibility unless previously agreed upon.
5. Creative Control and Editing

We maintain full creative control over the final editing and style of your photos/videos.

Raw or unedited files will not be released.

Turnaround time is typically 3 business days from the shoot date, though this may vary depending on workload.
6. Image Use and Copyright

All images and videos remain the copyright of Magical Moments.

We may use images/videos for our portfolio, website, and social media unless you notify us in writing prior to the session.

Clients receive a non-exclusive, non-transferable license for personal use. Commercial use requires prior written consent.
7. Delivery and Storage

Final media will be delivered digitally via Google Drive.

We recommend downloading and backing up your files immediately. We do not guarantee storage beyond 2 months.
8. Liability

We will take all reasonable care during the session, but will not be liable for any loss, damage, or injury sustained during the shoot.

In the unlikely event of equipment failure, illness, or unforeseen circumstances, we reserve the right to reschedule or offer a full refund of the session fee.
9. Force Majeure
We are not liable for delays or cancellations due to circumstances beyond our control (e.g., weather, natural disasters, pandemics, or government restrictions).
10. Governing Law
These Terms and Conditions are governed by the laws of QLD.
